Terms and Conditions
These Terms govern Visiolix, including the website, editor, hosted projects, AI Assistant, and public project viewer. Visiolix is provided by SIMULUX Interactive 3D Web ("we", "us").
1. Who may use Visiolix
You may view public projects without an account. An account is required to save and manage your own projects. When you register, you agree to these Terms. If you use Visiolix for an organisation, you must be authorised to act for it. You must provide accurate registration details, keep your sign-in credentials secure, and tell us promptly if you suspect unauthorised use of your account.
The published plan description states which features and limits apply to an account. Business and Enterprise services are offered by individual agreement; that agreement takes precedence where it expressly differs from these Terms.
2. Free and paid plans
The Free plan has no subscription charge. Paid plans, when offered, provide the features and limits shown before purchase. A plan description is part of the agreement for that plan. We may change the price or features offered to new customers; changes to an existing subscription are governed by its agreed terms and applicable law.
Before you place a paid order, the checkout will show the selected plan, billing interval, total price including applicable taxes, automatic renewal, accepted payment methods, and the date or conditions for access. A paid subscription begins only after the order is accepted and the first payment is confirmed.
3. Renewal, cancellation, and refunds
A paid subscription renews for the selected monthly or annual billing interval until it is cancelled. You may cancel at any time. An ordinary cancellation takes effect at the end of the current paid interval, and no further renewal payment is due. You may request cancellation at kontakt@visiolix.de; an online cancellation route will also be provided where required by law. We will confirm the cancellation and its effective date.
If a payment fails, we may retry it and contact you. After reasonable notice, we may suspend paid features or move the account to the Free plan while payment remains outstanding. A plan downgrade may restrict the ability to create, edit, or publish projects that exceed the lower plan's limits. It does not by itself transfer ownership of your content to us.
We do not offer a voluntary refund of unused time after an ordinary cancellation. This does not affect a statutory right of withdrawal, remedies for a defective digital service, or any other mandatory refund right. Where a consumer has a right of withdrawal, the checkout will provide the required information and any legally required request to begin service during the withdrawal period before the order is placed.
4. Your content and the licence needed to provide the service
You retain your rights in the files, models, images, text, notes, and other material you upload or create ("your content"). You must have the rights and permissions needed to use and publish it. You grant us a non-exclusive licence to host, copy, process, adapt to the technical requirements of the service, display, and transmit your content only as needed to operate Visiolix and follow your project visibility choices. This licence ends when the content is deleted from the service, subject to legally required retention and temporary backup copies.
Visiolix software, branding, templates, and material supplied by us or our licensors remain with their respective rights holders. Your right to use the service does not transfer those rights to you.
5. Private and public projects
Newly saved projects are private unless you choose to make them public. A public project and its associated guide can be accessed by others through its link, including a shared QR code. Do not publish confidential information or material you do not have permission to disclose. You can make a public project private or delete it using the available project controls. Copies already downloaded, captured, or cached by others may remain outside our control.
Publishing a project does not make Visiolix its author, editor, or technical approver. Other people's public projects remain their content; you may view them through the service, but you must respect their rights.
6. Prohibited content and use
You must not upload, create, or publish content that is illegal; infringes another person's rights; contains pornography or sexual exploitation; depicts graphic violence; promotes violence, self-harm, or other unlawful harm; or contains threats or hateful abuse. This rule covers private and public projects. Legitimate technical safety instructions and non-graphic hazard warnings are allowed.
You must not use Visiolix to distribute malware, send spam, interfere with the service, bypass access controls or plan limits, access another person's account or private project without permission, or use the service in breach of applicable law.
7. Accuracy and safety of guides
You are responsible for the content and correctness of every user guide, assembly guide, maintenance guide, operating instruction, or other material you create or publish with Visiolix. Before sharing or using a guide, you must check that its steps, measurements, warnings, images, and references are accurate, complete, current, and suitable for the intended equipment and audience. You must obtain any review or approval required by law, applicable standards, the manufacturer, or your organisation.
Visiolix is an authoring and publishing tool. We do not routinely validate or certify user-created guides. A published guide, visualisation, or generated suggestion does not replace qualified technical review, manufacturer instructions, or required safety procedures. This allocation of responsibility for user content does not limit our responsibility for the Visiolix service or any liability that cannot legally be excluded.
8. AI Assistant
If you use the AI Assistant, your request and relevant project context are sent to an external model service to generate a response or proposed change. AI output can be incomplete or incorrect. You must review and approve any proposed changes and verify the resulting project and guide before relying on them. Do not submit information to the AI Assistant unless you are allowed to send it for this processing. Usage limits, when applicable, are shown in the plan description.
9. Content reports and moderation
To report illegal content or a breach of these Terms, email kontakt@visiolix.de with the project link or other details that identify the content and explain the concern. We assess reports and may restrict access to content, remove it, or suspend or close an account when justified. We may also act when we become aware of a serious violation without receiving a report. Where the law requires it, we will explain a restriction and provide a way to challenge the decision.
10. Service availability and changes
Maintenance, updates, security work, and outages may affect access to Visiolix. We do not promise uninterrupted availability unless a separate service agreement says otherwise. We provide updates required by applicable law and remain responsible for the service as required by law.
We may change features for valid reasons, including security, legal compliance, technical compatibility, or improving how the service works. Changes to a continuously supplied digital service will be made without additional cost to the consumer, with the notices and termination rights required by law if access or use is materially affected.
11. Ending an account and your data
You may delete your account through the account controls. This removes your saved projects and project files from the service, subject to any information we must retain by law and temporary backup retention. Save copies of any content you need before deleting the account. Ending a paid subscription and deleting an account are different actions; cancel a subscription separately to stop its renewal.
We may suspend or end access for a serious or repeated breach of these Terms, a security risk, or a legal obligation. Where appropriate and lawful, we will give notice and an opportunity to resolve the issue. Ending access does not remove rights or obligations that accrued beforehand.
12. Liability and consumer rights
We are responsible for Visiolix and our own obligations under applicable law. We are not responsible for the accuracy of a guide or other material supplied by a user merely because it was created, stored, or published with our tools. Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot lawfully be excluded. Your mandatory rights concerning digital services, cancellation, withdrawal, and remedies remain intact.
13. Privacy
Our Privacy Notice explains how personal data is processed for accounts, projects, the AI Assistant, communications, and service operation. It is separate from these Terms.
14. Changes to these Terms
We may update these Terms to reflect changes to the service, law, or business operation. We will make the new text available with its date and give advance notice of material changes affecting existing accounts. Where a change requires your agreement, we will ask for it. An update does not take away rights already acquired under an existing paid contract or mandatory law.
15. Applicable law and disputes
German law applies to these Terms. If you are a consumer, this choice does not deprive you of mandatory protections in the country where you habitually live. The courts with jurisdiction are determined by applicable law. Please contact us first if you have a question or complaint so we can try to resolve it.
